1. Introduction

Welcome to euroaxislogistics. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access our website or use our services.

2. Definitions

For the purposes of these Terms:

• "Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to euroaxislogistics, Logistics Park 123, 1012 AB Amsterdam, Netherlands.
• "Service" refers to the logistics and transportation services provided by the Company.
• "Website" refers to euroaxislogistics's website, accessible from www.euroaxislogistics.com
• "You" means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
• "Goods" means any items, products, or materials that are transported or stored by the Company on behalf of the Customer.

3. Services

euroaxislogistics provides logistics and transportation services, including but not limited to:

• Road freight transportation
• Sea freight transportation
• Air freight transportation
• Warehousing and storage
• Supply chain management
• Customs clearance services

The specific services to be provided will be detailed in a separate service agreement or contract between euroaxislogistics and the Customer.

4. Service Rates and Payment

4.1 Rates

Our service rates are determined based on the specific requirements of each shipment or service. Rates may vary depending on factors such as distance, weight, volume, type of goods, special handling requirements, and other relevant factors.

4.2 Payment Terms

Payment terms will be specified in the service agreement or contract. Unless otherwise agreed, payment is due within 30 days from the date of invoice. We accept payment by bank transfer, credit card, or other methods as specified in the invoice.

4.3 Late Payment

Late payments may be subject to interest charges at a rate of 2% per month or the maximum rate permitted by law, whichever is lower. We reserve the right to suspend services for accounts with outstanding balances.

5. Customer Responsibilities

As a customer, you are responsible for:

• Providing accurate and complete information about the goods to be transported or stored
• Ensuring that goods are properly packaged and labeled
• Complying with all applicable laws and regulations regarding the transportation and storage of goods
• Obtaining any necessary permits, licenses, or authorizations for the transportation of goods
• Paying all applicable duties, taxes, and fees related to the transportation of goods
• Informing us of any special handling requirements or hazardous materials

6. Liability and Insurance

6.1 Limitation of Liability

Our liability for loss or damage to goods is limited to the lesser of:

• The actual value of the goods
• €8.33 per kilogram of gross weight of the goods lost or damaged
• The maximum amount specified in applicable international conventions or national laws

We are not liable for any indirect, consequential, or special damages, including but not limited to loss of profit, loss of market, or loss of opportunity.

6.2 Insurance

We recommend that customers obtain appropriate insurance coverage for their goods. We can arrange insurance coverage at the customer's request and expense.

7. Claims

Any claims for loss or damage to goods must be submitted in writing within 14 days of delivery or, in the case of non-delivery, within 30 days from the date when the goods should have been delivered. Claims submitted after these periods may be rejected.

8. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, lockouts, riots, acts of war, epidemics, governmental actions, or other similar events.

9. Termination

Either party may terminate the service agreement with 30 days' written notice. We reserve the right to terminate services immediately in case of non-payment, breach of these Terms, or violation of applicable laws or regulations.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.
